Please read these terms carefully before using our website or engaging Strux Roofing for services.

Important: These Terms and Conditions constitute a legally binding agreement between you and Strux Roofing. By accessing our website or entering into a service agreement with us, you confirm that you have read, understood, and agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using the Strux Roofing website (the "Site") or by requesting, scheduling, or receiving roofing services from Strux Roofing ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms, you must not use our website or engage our services. We reserve the right to update these Terms at any time, and your continued use of the Site or services constitutes acceptance of any changes.

2. Services

Strux Roofing provides residential and commercial roofing services in Florida, including but not limited to roof replacement, roof repair, storm damage restoration, roof inspections, and gutter installation. All work is performed by licensed and insured professionals.

Strux Roofing is a Florida State Certified Roofing Contractor. All work is subject to applicable Florida building codes and permitting requirements. The scope of any specific project will be defined in a written proposal or contract signed by both parties.

  • All services are subject to availability and scheduling within our service area.

  • We reserve the right to decline any project that falls outside our licensed scope of work.

  • Subcontractors may be used for certain aspects of projects; all subcontractors are vetted and required to carry appropriate insurance.

  • Emergency services are subject to availability and may be subject to additional fees.

3. Estimates & Proposals

All estimates provided by Strux Roofing are based on visible conditions at the time of inspection. Written proposals are valid for 30 days from the date of issuance unless otherwise noted. Pricing may be subject to change if site conditions, material costs, or project scope change after the initial estimate.

  • Estimates do not constitute a binding contract until a written proposal is signed by the Customer and accepted by Strux Roofing.

  • Unforeseen conditions discovered during the course of work (e.g., hidden rot, structural damage, code violations) may require a change order that could affect the final project cost.

  • Change orders will be presented to the Customer in writing and require approval before additional work proceeds.

  • Free estimates are provided at no obligation for standard residential and commercial projects.

4. Payment Terms

Payment terms will be outlined in your project proposal. Standard payment structure is as follows unless otherwise agreed in writing:

  • Deposit — A deposit of up to 50% of the total contract amount may be required prior to materials being ordered or work beginning.

  • Progress Payments — For larger projects, progress payments may be scheduled at milestones defined in the contract.

  • Final Payment — The remaining balance is due upon completion of work and Customer's satisfactory inspection.

  • Late Payments — Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance.

  • Returned Payments — Returned checks or failed electronic payments may incur a returned payment fee of $50.

We accept cash, check, and major credit cards. Financing options may be available through third-party providers and are subject to their terms and approval.

5. Warranty

Strux Roofing stands behind the quality of our workmanship. Our warranty terms are as follows:

  • Workmanship Warranty — We provide a written workmanship warranty on all completed roofing installations. Specific warranty duration will be stated in your project contract.

  • Manufacturer Warranty — Many materials we install carry separate manufacturer warranties. We will provide manufacturer warranty documentation upon project completion where applicable.

  • Warranty Exclusions — Warranties do not cover damage caused by acts of God, extreme weather events, improper maintenance, modifications made by others after project completion, or pre-existing structural deficiencies not identified prior to work.

  • Warranty Claims — To initiate a warranty claim, contact us in writing within the warranty period. We will inspect the issue within a reasonable timeframe and make covered repairs at no cost to you.

Warranties are non-transferable unless otherwise agreed in writing at the time of project completion.

6. Insurance Claims

Strux Roofing frequently works with homeowners and property owners on insurance-covered repairs. The following terms apply to insurance claim projects:

  • We will work directly with your insurance adjuster on your behalf; however, final approval of any insurance claim rests solely with your insurance carrier.
  • Strux Roofing does not guarantee that an insurance claim will be approved or that the approved amount will cover the full scope of repairs needed.
  • The Customer is responsible for any deductible, depreciation, or shortfall between the approved insurance proceeds and the contracted scope of work.
  • We comply with all Florida statutes governing public adjusters and roofing contractors, including prohibitions against waiving insurance deductibles.
  • A signed Assignment of Benefits (AOB) agreement, if applicable, will be executed as a separate document with its own disclosures as required by Florida law.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Strux Roofing's total liability to you for any claim arising out of or relating to our services or these Terms shall not exceed the total amount paid by you to Strux Roofing for the specific project giving rise to the claim.

We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of revenue, loss of use, or damage to personal property not directly caused by our negligence, even if we have been advised of the possibility of such damages.

Note: Strux Roofing maintains general liability and workers' compensation insurance as required by Florida law. Certificates of insurance are available upon request.

8. Property Access & Site Conditions

By scheduling roofing services, you grant Strux Roofing and its personnel reasonable access to your property as necessary to complete the agreed work. You agree to:

  • Ensure the work area is reasonably clear and accessible on the scheduled start date.

  • Notify us of any known hazards, underground utilities, fragile landscaping, or special property conditions prior to project commencement.

  • Secure or remove any outdoor furniture, vehicles, or items near the work area that may be affected by roofing activity.

  • Ensure that animals are secured and not present in or near the work area during project hours.

Strux Roofing will take reasonable precautions to protect your property during the work. We are not responsible for minor landscaping disturbance, dirt, or debris consistent with normal roofing operations, though we will perform a thorough cleanup upon project completion.

9. Cancellation Policy

You may cancel a signed contract subject to the following terms:

  • Cancellation before materials are ordered — You may cancel without penalty if written notice is provided before materials have been ordered or work has commenced.

  • Cancellation after materials are ordered — If materials have been ordered or custom-fabricated, you will be responsible for the cost of those materials and any applicable restocking fees.

  • Cancellation after work commences — If work has begun, you are responsible for the value of all labor and materials completed or installed to date, plus any demobilization costs.

  • Florida Right of Rescission — If applicable under Florida law, residential customers may have a 3-business-day right to cancel a home improvement contract entered into at their residence. Any such right will be disclosed in your written contract.

Strux Roofing reserves the right to cancel or reschedule work due to unsafe weather conditions, safety concerns, or circumstances beyond our control. We will notify you promptly and reschedule at the earliest available date.

10. Website Use

Your use of the Strux Roofing website is subject to the following conditions:

  • The Site and its content are provided for informational purposes only. Nothing on the Site constitutes a binding offer or guarantee of services.

  • You agree not to use the Site for any unlawful purpose, to transmit harmful code, to attempt unauthorized access, or to engage in any activity that could damage or impair the Site's functionality.

  • We make no warranty that the Site will be uninterrupted, error-free, or free of viruses or harmful components.

  • Content on the Site, including pricing references and service descriptions, is subject to change without notice.

11. Intellectual Property

All content on the Strux Roofing website — including text, images, logos, graphics, and code — is the property of Strux Roofing or its content licensors and is protected by applicable copyright and trademark laws.

12. Governing Law

These Terms and any disputes arising from your use of our website or services shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

Any legal action or proceeding relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Orange County, Florida. You consent to personal jurisdiction and venue in those courts.

13. Dispute Resolution

We value our customer relationships and prefer to resolve disputes amicably. In the event of a dispute, we ask that you first contact us directly so we can work toward a fair resolution. Most concerns can be addressed promptly through good-faith communication.

If a dispute cannot be resolved informally, the parties may elect to pursue mediation before initiating any legal proceedings. Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction where necessary to prevent irreparable harm.

Florida homeowners may also have rights under the Florida Construction Industry Licensing Board (CILB) and may file complaints with the Department of Business and Professional Regulation (DBPR).

14. Changes to Terms

Strux Roofing reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site, and the "Last Updated" date will be revised accordingly. Your continued use of the Site or engagement of our services following any updates constitutes your acceptance of the revised Terms.
